Privacy notice and terms of use
1. Who we are
Everest Multi-Solutions (K) Ltd (“Everest”, “we”) is a limited company incorporated in Kenya and governed by the Companies Act, 2015, with its recycling yard in Bamburi, Mombasa County. We are the data controller for the personal data described here. For anything about privacy, contact us at info@everest-solutions.co.ke or 0702 183 666.
2. What we collect and why
When you send a request through our forms we receive your name, organisation, mobile number, email address (if you give one), location, the materials and rough quantity, your preferred day, whether you need a certificate of destruction, and your message. We use it to answer you, to arrange a collection or a site visit, and to keep a record of what was agreed. We process it because you asked us to take these steps before or under an agreement with us, in line with section 30 of the Data Protection Act, 2019.
Giving us your details is voluntary, but we cannot arrange a pickup or reply without the details the form requires: your name and mobile number and, depending on the request, your organisation, location, whether you are within Mombasa County, the materials and a rough quantity.
To stop spam and abuse, the form also keeps a coded (pseudonymised) version of your connection’s IP address with your request, in a short-lived counter and in our form log. That is in our legitimate interest in keeping the form working. Our web host’s standard server logs record IP addresses, the pages requested and browser details for security and troubleshooting.
We do not use your details for marketing and we never sell them.
3. Where it is kept and for how long
Requests are stored on our web server and delivered to our office mailbox. Both are run for us by our hosting provider, Truehost.
Requests stored on our web server are deleted automatically after 24 months. If a request becomes part of a business record, for example a supplier or customer account, that record is kept for at least five years as the Tax Procedures Act, 2015 (section 23) requires.
4. Who can see it
Our office staff who handle requests, and our hosting and email provider, which processes the data on our behalf. We share it with anyone else only when the law requires us to.
5. Your rights
The Data Protection Act, 2019 gives you these rights:
- to be informed of the use to which your personal data is put, and to access the personal data we hold about you (section 26);
- to object to our processing of your personal data (section 36);
- to ask us to restrict how we process your personal data (section 34);
- to receive your personal data in a structured, commonly used and machine-readable format (section 38);
- to ask us to correct data that is inaccurate, out-dated, incomplete or misleading, and to erase data that we are no longer authorised to keep, or that is irrelevant, excessive or obtained unlawfully (section 40).
Contact us to use any of these rights. If you are not satisfied with our answer, you can complain to the Office of the Data Protection Commissioner.
6. Security and breaches
This site uses HTTPS. Requests are stored outside the public part of the web server, readable only by our hosting account, and the form is protected against automated abuse. If a breach is likely to put your rights at risk, we will notify the Data Protection Commissioner within 72 hours of becoming aware of it, and tell you where the law requires us to (section 43).
7. Cookies and tracking
This website sets no cookies and uses no analytics, advertising or social-media trackers. Its fonts, images and scripts all come from our own server. If you contact us on WhatsApp, WhatsApp’s own terms apply to that conversation.
8. Terms of use
- This site describes our services in general. Rates, collection days and availability are confirmed by our office for each request; nothing here is an offer or a quotation.
- The solar calculator gives estimates from public sunshine data and the assumptions it lists. A site visit is needed before any design or quote.
- Please ask before reusing the text or photos on this site.
- These terms are governed by the laws of Kenya.
9. Changes and contact
We update this notice when our practices change; the date at the top shows the current version. Questions: info@everest-solutions.co.ke, 0702 183 666, or Bamburi, Mombasa County, Kenya.
